The area of domestic relations law is vast and complex at best. It is sometimes overwhelming. QDRO Services, L.L.C. was formed with one primary purpose in mind -
TO ASSIST FAMILY LAW PRACTITIONERS WITH THE DIVISION OF RETIREMENT BENEFITS AND A QDRO SOLUTION WHEN IT'S NECESSARY.
Our staff has years of experience working on numerous domestic relations matters, which included qualified and non-qualified employee benefits plans, military benefits and state, local and federal government benefits. We can put those years of experience to work for you. To that end we offer the following services:
- Drafting qualified and non-qualified plan QDROs
- Drafting military system qualifying court orders
- Drafting state, local and federal system court orders acceptable for processing
- Drafting language in decrees and property settlement agreements related to alimony, stock options, non-qualified deferred compensation plans and many more.
- Administration of orders after filing, which includes transmitting the order to the Plan Administrator and follow up, redrafting, if necessary
- Tracing separate and marital property interests in defined contribution plans
- Economical, fixed fees (hourly for tracing)
- Expert witness testimony regarding qualified and non-qualified plans, federal, state and local government pension systems and military systems and
- Present value calculations for defined benefit plans.
In addition, if you will call us ahead of time and provide us with a signed release authorization, we will give you a "Heads-Up Report" on any particular plan or system, which will let you know what the attributes of the plan are that are important to you and your client's decision making.
We seldom use a plan's sample orders as we have found that sample orders provided by the plans are sometimes heavily biased in favor of participants, and in some case, could border on malpractice if used by an alternate payee's attorney. By working with plan administrators, we are able to determine all of the benefits and options in the plan and the QDRO procedures that create additional value for your client(s).
In addition, we draft orders for child support collections agencies, to secure the payment of past due child support from qualified and non-qualified plans, federal, state and local government pension systems and military systems.
In some cases, we cannot do any better cost-wise than an attorney's own staff on the drafting side. However, in most cases, we believe that we can bring more value to an order than a person who does not work full time in this area. This comes from our ability to speak both "legalese" and "pension language", a bridge that most attorneys, paralegals and plan administrators have difficulty crossing.
